Policy Regarding Limitation of Information Use and Disclaimer of Opinion

As a condition of receiving, accessing and using certain INFORMATION provided by Hyperion Research, we require that the RECEIVING PARTY read and agree to our policy regarding the Limitation of Information Use and Disclaimer of Opinion (the “POLICY”).  By receiving, accessing or using the INFORMATION, the RECEIVING PARTY acknowledges that it has read, understands and agrees to comply with the POLICY.

As the RECEIVING PARTY wishes to receive certain INFORMATION from Hyperion Research, and Hyperion Research agrees to provide such INFORMATION under specific limitations of use and with explicit disclaimer of opinion, the PARTIES, with exchange of mutual consideration, AGREE as follows:

  1. The INFORMATION, whether in whole or part, or as used in separate compilations, is protected by copyright, and is considered the confidential and proprietary information of Hyperion Research. The RECEIVING PARTY will exercise due diligence to maintain the confidentiality of the INFORMATION, subject to any bona fide legal requirements of disclosure. Additional INFORMATION may be provided in the future, subject to this POLICY by reference.
  2. The INFORMATION is provided to RECEIVING PARTY for the limited purpose of its own internal knowledge, and may not be used, shared or otherwise communicated, either in whole or part, or used in a separate compilation, without the express written approval of Hyperion Research. Particularly, but not limited to, RECEIVING PARTY will not share INFORMATION, in whole or part, or in separate compilation, with an outside third party, such as another company, client, consultant, or software vendor.
  3. The RECEIVING PARTY acknowledges that the INFORMATION are the opinions of Hyperion Research, and may include errors, omissions, or inaccuracies. Vendor related information may not have come directly from the vendor itself. The INFORMATION is often the result of compiling information from multiple sources. The opinions expressed are subject to change without notice. ALL SUCH INFORMATION IS EXPLICITLY DISCLAIMED, AND HYPERION RESEARCH ACCEPTS NO LIABILITIES FOR ERRORS, OMISSIONS OR INADEQUACIES, OR THE INTERPRETATION THEREOF.
  4. The RECEIVING PARTY will maintain all attribution notices, including but not limited to copyright notices, related to all INFORMATION, whether in whole or part, or as used in separate compilations. Copyright notice shall be,“Copyright © Hyperion Global Partners, LLC.” Source of information notice shall be,“Source: Hyperion Research, www.hgpresearch.com”.
